Pur­po­se of the job

Ensu­ring freedom‐to‐operate for the employer’s pro­duc­ts and rep­re­sen­ting and enfor­cing the employer’s inte­rests in liti­gious IP pro­cee­dings


  • Tech­ni­cal degree or phy­sics degree
  • Rele­vant pro­fes­sio­nal expe­ri­ence in the inde­pen­dent and auto­no­mous con­duct of freedom‐to‐operate pro­cee­dings, liti­gious IP pro­cee­dings befo­re patent offices (DPMA, EPO, pos­si­b­ly USPTO), such as oppo­si­ti­on and appeal pro­cee­dings and patent nul­li­ty pro­cee­dings
  • Expe­ri­ence in liti­gious IP pro­cee­dings befo­re the District Courts, District Court if app­li­ca­ble
  • Appro­vals befo­re the Ger­man Patent and Trade­mark Office as well as the European Patent Office


  • Respon­si­bi­li­ty and per­for­mance of glo­bal freedom‐to‐operate ana­ly­ses to ensu­re freedom‐to‐operate for the employer’s pro­duc­ts pri­or to their mar­ket ent­ry
  • Rep­re­sen­ta­ti­on of the employ­er in liti­gious IP pro­cee­dings (oppo­si­ti­on, appeal, nul­li­ty) befo­re courts (LG, BGH) and patent offices (DPMA, EPO, pos­si­b­ly USPTO)
  • Pre­pa­ra­ti­on of plea­dings in liti­gious IP pro­cee­dings (patent offices and courts)
  • Con­trol­ling and moni­to­ring exter­nal lawy­ers in liti­gious IP pro­cee­dings with regard to qua­li­ty, costs and adhe­rence to sche­du­les
  • Proac­tive detec­tion of pos­si­ble infrin­ge­ments of own pro­per­ty rights by third par­ties and pro­se­cu­ti­on and enforce­ment of rights against third par­ties (judi­ci­al and/or extra­ju­di­ci­al)
  • Deve­lop­ment and imple­men­ta­ti­on of defence and counter‐strategies with regard to pos­si­ble attacks against the employ­er on the basis of third‐party pro­per­ty rights
  • Trai­ning of employees and manage­ment of R&D and mar­ke­ting depart­ments with regard to IP com­pli­an­ce
